My airbags did not deploy in an accident. Can I sue the manufacturer?

submitted by Carlos P.

The Injury Legal Team’s answer:

It depends.  More facts are needed to see if you truly have a claim.  Cars are equipped with sensors and based upon the location and force of the impact, certain airbags will deploy.  Assuming they should have deployed in your accident, then yes, theoretically you have a claim.  But whether it’s worth it is another story.  Taking on auto manufacturers on an airbag case is a major undertaking.  It will be a long and expensive fight.  The manufacturer will also be able to point the finger at the cause for the accident (you or the other driver).  Thus, your injuries must essentially be life changing to warrant such a case.
