Ask a PI Lawyer

I was bitten by a dog, who is responsible?

submitted by Jorge C.

The Injury Legal Team’s answer:

In California, the owner of a dog is strictly liable for injuries caused by a dog bite.  This means they are responsible, whether or not they were negligent in controlling the dog, whether or not the dog had or had not attacked anyone before.  There is no one free bite rule that many people talk about.  Depending on the situation, others may be responsible also if the dog was in someone else’s care.
